Court restrains Nigerian Army from arresting Tinubu

Bola-Tinubu-BellaNaijaThe former governor of Lagos state and leader of the All Progressives Congress, APC, Bola Tinubu, has obtained a court injunction stopping his arrest or harassment by the Nigerian army.

Mr. Tinubu was Thursday granted an interim injunction restraining the Chief of Army Staff, Kenneth Minimah, his privies, agents from arresting, detaining, harassing or intimidating the former Lagos governor, pending the determination of the motion on notice.

Mr. Tinubu had said this week that he was ready for arrest. He made the remarks while speaking at the 7th edition of the Bola Tinubu colloquium.

In the order granted through Mr. Tinubu’s lawyers, Femi Falana, Judge J.T. Tsoho of the Federal High Court in Lagos also barred the Chief of Army Staff or his privies, agents and servants from further laying siege on the home of Bola Tinubu situated at number 26, Bourdillon Street, Ikoyi.

The Judge ordered “That leave is granted to the applicant to serve the originating motion on notice on the respondent at the Ministry of Defence, area 10 Abuja, federal capital territory.

“That the respondent whether by himself privies agent and servant are restrained from arresting, detaining harassing or intimating d applicant pending d determination of d motion on notice; that the respondent whether by himself, agents, privies and servants are restrained from further laying siege on d home of applicant at 26, Bourdillon Street, Ikoyi, Lagos pending d determination of motion on notice.

Justice Tsoho also ordered “that the respondent is restrained from preventing the applicant from participating in the 2015 general election pending the determination of the motion on notice filed herein”.

The case was subsequently adjourned till March 31 for the determination of the motion on notice.
