A court filing submitted by the Independent Corrupt Practices and Other Related Offences Commission (ICPC) has revealed that the anti-corruption agency recovered about 67 items that include electronic devices, real estate and property records, as well as financial documents during a search of the Abuja residence of former Governor of Kaduna State, Nasir El-Rufai, last month.
The agency filed the list alongside its counter-affidavit at the Federal High Court in Abuja to oppose a N1 billion fundamental rights enforcement suit instituted by El-Rufai to challenge the ICPC’s search of his home in Abuja.
In the suit, El-Rufai asked the court to declare the search of his residence illegal, while also stopping them from relying on any item or information recovered during the exercise in any court proceedings.
He further sought compensation to the tune of N1 billion for the violation of rights, which he claimed the search amounted to.
However, the ICPC urged the court in its counter-affidavit, to dismiss the suit, stating that the search, which was witnessed by his son and wife was carried out lawfully.
The ICPC‘s counter-affidavit explained its position on the matter, stating that it was accompanied by a series of supporting documents, which include El-Rufai’s hand-written statements and the list of electronic devices recovered during the search.
A hand-written document that was also among the court filings contains the complete list of all the 67 items recovered from the house at 12 Mambilla Street, Asokoro, Abuja.
El-Rufai has since remained in the custody of the ICPC, since the day he was arrested on February 19, by the operatives of the agency last month, but his family has denied some claims in the ICPC’s counter-affidavit, which include alleged recovery of a phone-tapping device recovered during the search.
After he was released from detention by the Economic and Financial Crimes Commission (EFCC), which detained him after he honored an invitation on Monday, 16 February, the African Democratic Congress (ADC) stalwart has remained in the ICPC custody.
He is facing prosecution by the State Security Service (SSS), over his claim of tapping the National Security Adviser, Nuhu Ribadu’s phone call. He is still in the ICPC’s custody as at the time of filing this report on Wednesday.
